Why does the income tax return lead the list?

One document, filed under penalty of perjury, that states where a person lives. That is why the rule puts it first.

19 RCNY 62-06(b) opens with the most recent federal or state income tax return showing the address. Since the August 3, 2026 emergency amendment it shares that standing with a driver's license or other DMV-issued identification, which also carries the base set alone. Only the fallback comes in a pair: a voter identification card plus one other proof, for the file that has neither a return nor DMV identification.

What does showing the address mean?

The address printed on the return has to be the property. A return showing somewhere else does not decide the question against you, but it does mean the strongest document in the file is pointing away from the unit, and the rest of the file then has to answer for it.

DOF's residency indicators start here for a reason. They include the address on state or federal income tax returns, receipt of residency-based benefits, and majority-of-days occupancy. The statutory list is including but not limited to, so nothing on it decides the matter by itself and nothing is a checkbox.

The amended return the final rule allows

The adopted rule lets an owner file an amended return before appealing. Read that for what it is: a correction path for a return that does not reflect where the person actually lived. It is not an invitation to restate anything.

Before you upload

  1. Confirm the return is the most recent one filed.
  2. Confirm the address on it is the property, unit designation included.
  3. Check it against the license, the registration, and the bills going into the same file.
  4. Keep the date in view: status is judged as of January 5, 2026, the taxable status date for the 2026-27 tax year.

January 5, 2026 fell months before the law was enacted on May 28, 2026. It is still the date that decides this year's surcharge, which is why a file built only from the weeks since the notice arrived tends to miss. The rest of the sequence is on the checklist.
